Terms of Service
Last updated: October 23, 2026
1. Scope and Relationship to Other Policies
These Terms of Service (the "Terms") govern access to and use of Tai Chi Walking, including the website and quiz funnel at taichiwalkingcoach.app, the member area at home.taichiwalkingcoach.app, the guided Tai Chi Walking programme, personalized movement and nutrition-related guidance, digital content, subscription access, optional add-ons, AI-supported features, customer support, and related services (collectively, the "Service").
The Service is operated by PMC Baltic FZ-LLC. The applicable Seller, contracting party, or Merchant of Record for a particular purchase may be identified at checkout, in the purchase confirmation, receipt, invoice, or other transaction record.
To the extent the same matter is addressed in more than one applicable document, the following order applies:
- mandatory law that cannot legally be waived;
- transaction-specific terms clearly displayed and accepted at checkout or otherwise agreed for the particular purchase;
- offer-specific promotional conditions, where applicable;
- Subscription Terms for recurring billing, renewal, cancellation mechanics, and subscription-specific commercial rules;
- Money-Back Policy for contractual Money-Back Guarantee eligibility and refund review;
- these Terms for general contractual matters; and
- Privacy Policy for personal-data processing.
Cookie-related information is addressed in the Cookie Policy.
2. Operator, Seller and Transaction Participants
PMC Baltic FZ-LLC is the default operator of the Service. A transaction-specific record may identify another authorized Seller, contracting party, distributor, or Merchant of Record for a particular purchase.
A payment processor, gateway, acquiring partner, payment administrator, or other payment-service provider may process payments, recurring billing, authentication, fraud screening, refunds, reversals, chargebacks, or related payment support without automatically becoming the contractual Seller.
Personal-data controller roles and data processing are governed by the Privacy Policy.
3. Acceptance and Electronic Contracting
You may accept these Terms by creating an account, accessing or using the Service, completing a purchase, selecting an acceptance or purchase-confirmation control, or taking another legally valid acceptance action. Electronic signatures, clickwrap acceptance, electronic records, and electronic transaction confirmations may be used to form and evidence the agreement to the extent permitted by applicable law.
Subject to the Privacy Policy and applicable law, relevant acceptance, checkout, purchase-confirmation, and transaction records may be retained for compliance, security, refund, fraud-prevention, and dispute purposes.
4. Eligibility and Legal Capacity
You may use the Service only if you have the legal capacity required to enter into these Terms under applicable law. If you make a purchase, you represent that you are authorized to use the payment method submitted for the transaction. You may not use the Service where doing so is prohibited by applicable law.
5. Accounts and Security
Where the Service uses an account or member-access system, you must provide accurate and reasonably current information and maintain the confidentiality of your login credentials or access method. You are responsible for activity reasonably attributable to your account, subject to mandatory law.
Notify us promptly at hello@taichiwalkingcoach.app if you suspect unauthorized access to or use of your account. We may request reasonable identity, account, or payment verification and may apply protective restrictions where account compromise, fraud, or abuse is reasonably suspected.
6. Description of the Service
Tai Chi Walking is a digital movement and general-wellness service centered on Tai Chi Walking. Depending on the features and purchases available to you, the Service may include a guided multi-day movement programme, walking and mobility sessions, personalized routines, progress check-ins, body-awareness and posture guidance, nutrition- and meal-related educational guidance, meal planning, downloadable resources, member content, AI-supported recommendations, and related digital tools.
The Service may personalize recommendations using information you provide about movement, stiffness, energy, routines, meals, preferences, discomfort, prior injuries or current conditions, and other relevant inputs. Similar users may receive similar or overlapping content.
7. Service Changes and Availability
We may add, remove, modify, replace, limit, suspend, or discontinue features, content, interfaces, methods, tools, integrations, or other functionality from time to time, subject to mandatory consumer rights and transaction-specific commitments. The Service may experience maintenance, downtime, security restrictions, technical interruptions, or reduced availability. Future or experimental features are not guaranteed unless expressly made part of a binding transaction.
8. Licence to Use the Service
Subject to these Terms and any applicable paid entitlements, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable licence to access and use the Service for its intended personal, non-commercial purpose during the applicable access period. No ownership right in software, content, programmes, plans, reports, recommendations, designs, branding, trademarks, or other intellectual property is transferred to you.
9. Acceptable Use
You must not use the Service in a way that is unlawful, fraudulent, deceptive, abusive, harmful, or inconsistent with these Terms. Without limitation, you must not:
- copy, reproduce, distribute, publish, resell, rent, sublicense, or commercially exploit the Service or proprietary content except as expressly permitted;
- reverse engineer, decompile, scrape, systematically extract, or attempt to derive source code or underlying technology except where such restrictions are prohibited by law;
- interfere with security, authentication, access controls, payment systems, servers, or networks;
- introduce malware or malicious code;
- impersonate another person, obtain unauthorized access to another account, or misuse a payment method;
- share, transfer, resell, or commercially exploit subscription access or credentials;
- circumvent promotional, account, subscription, or refund restrictions through linked accounts, payment methods, identities, or other deceptive means; or
- use personalized or AI-supported outputs as a substitute for professional medical, physiotherapy, dietetic, mental-health, legal, financial, or other regulated advice.
10. User Content and Submitted Materials
Where you submit quiz answers, movement check-ins, messages, meal or snack photos, ingredient-label photos, personalization inputs, health- or wellness-related information, feedback, support communications, refund evidence, or other materials through the Service ("User Content"), you retain ownership of that User Content to the extent you own it.
You grant us only the rights reasonably necessary to host, process, transform, transmit, display, and otherwise use User Content to provide, secure, support, personalize, and administer the Service and for other purposes actually described in the Privacy Policy. You represent that you have the rights and permissions necessary to submit the User Content and that your submission does not violate applicable law or third-party rights.
11. Intellectual Property
The Service, including its software, interfaces, quiz logic, Tai Chi Walking programme, educational materials, movement sequences, personalized outputs, designs, algorithms, templates, trademarks, logos, branding, and other proprietary materials, is owned by or licensed to the applicable rights holders and protected by intellectual-property laws. Except for rights expressly granted under these Terms, all rights are reserved.
12. Feedback
If you voluntarily provide feedback, ideas, suggestions, or product-improvement proposals about the Service, we may use that feedback without an obligation to compensate you, provided that this does not transfer ownership of unrelated User Content submitted for another purpose.
13. Payments and Subscriptions
Paid access, subscription-specific commercial terms, introductory or promotional phases, recurring billing, renewal, cancellation, failed-payment handling, and related subscription mechanics are governed by the transaction-specific checkout terms, purchase confirmation, and Subscription Terms. Contractual Money-Back Guarantee eligibility and refund review are governed by the Money-Back Policy and applicable law.
These Terms do not independently create a refund, cancellation, pricing, or billing entitlement that conflicts with the applicable transaction-specific terms or specialized policies.
14. Third-Party Services
The Service may depend on or integrate with third-party hosting, database, payment, email, AI, analytics, advertising, security, or other technology and service providers. Third parties may operate under their own terms and privacy notices where they independently control the relevant service. We do not guarantee continuous availability, accuracy, or security of third-party services outside our reasonable control.
15. Personalized and AI-Supported Outputs
The Service may generate or provide personalized movement guidance, routines, meal-related suggestions, progress summaries, schedules, recommendations, and other outputs based in whole or in part on information you provide and your interactions with the Service.
AI-supported outputs may be incomplete, inaccurate, inconsistent, or unsuitable for a particular person or circumstance. They are not guaranteed to be unique, current, error-free, or appropriate for every user. You should independently verify important information and use reasonable judgment before relying on an output.
AI-supported features are not licensed professionals and must not be relied on to diagnose a condition, assess whether a medical condition or injury is safe for exercise, prescribe treatment, or replace advice from a qualified healthcare professional.
16. Health, Movement, Nutrition and Safety Disclaimer
The Service is intended for informational, educational, movement, lifestyle, and general-wellness purposes. It is not medical care, physiotherapy, diagnosis, treatment, emergency care, or individualized professional nutrition or dietetic advice.
Movement, breathing, mobility, posture, food, sleep, stress, and wellness content may not be suitable for every person. Individual responses and results vary, and no specific weight, health, pain, sleep, energy, mobility, emotional, or other outcome is guaranteed.
If you have a medical condition, current or previous injury, unexplained pain, significant mobility limitation, or concern about whether a movement or nutrition change is appropriate for you, seek advice from a qualified healthcare professional before relying on the Service. Stop an activity and seek appropriate medical help if you experience concerning pain, chest pain, severe shortness of breath, fainting, or other symptoms that may require professional assessment.
Nothing in this section limits remedies that applicable law provides if the Service is defective, non-conforming, or materially different from what was promised in the applicable transaction.
17. No Guaranteed Results
Experiences and outcomes vary between users. Testimonials, examples, estimates, recommendations, progress summaries, or illustrative results do not guarantee the same result for any particular user.
18. Suspension and Termination
We may suspend, restrict, or terminate access where reasonably necessary because of material breach, fraud, payment abuse, security risk, unlawful conduct, infringement, misuse, account compromise, or legal or operational necessity, subject to applicable law. Suspension or termination resulting from a user's material breach does not by itself create a refund entitlement.
19. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis. To the extent permitted by law, implied warranties that may lawfully be disclaimed are disclaimed, and we do not warrant that the Service will be uninterrupted, error-free, permanently available, or suitable for every user. Mandatory statutory guarantees, express promises incorporated into the applicable transaction, and non-waivable consumer remedies remain unaffected.
20. Limitation of Liability
To the maximum extent permitted by applicable law, the applicable Operator, Seller, affiliates, directors, officers, employees, contractors, licensors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or similar damages, or for loss of profits, revenue, business, goodwill, data, or opportunity, to the extent such loss may lawfully be excluded.
Where legally permitted, aggregate contractual liability arising out of or relating to the Service giving rise to the claim will not exceed the total amounts actually paid by you for that Service during the twelve (12) months immediately preceding the event giving rise to the claim, or any greater minimum amount that applicable law does not permit to be reduced.
Nothing in these Terms excludes or limits liability that applicable law does not allow to be excluded or limited.
21. Indemnification
To the extent permitted by applicable law, you agree to indemnify or reimburse the applicable Operator and its affiliates, directors, officers, employees, contractors, licensors, and agents against third-party claims, liabilities, losses, damages, costs, and reasonable expenses arising from your unlawful use of the Service, infringement of third-party rights through User Content you submit, fraud, or material breach of these Terms. This does not require you to indemnify us for our own negligence, statutory duties, or liabilities that cannot lawfully be shifted to a consumer.
22. Claims, Evidence and Enforcement
Subject to the Privacy Policy and applicable law, relevant account, acceptance, transaction, access, delivery, support, cancellation, communication, payment, and usage records may be used to establish, exercise, or defend legal rights. We may reasonably investigate suspected fraud, abuse, payment or chargeback misuse, infringement, account compromise, or violations of these Terms and cooperate with competent authorities or payment participants where legally required or reasonably necessary.
23. Applicable Law and Mandatory Consumer Rights
These Terms are subject to applicable law. Nothing in these Terms deprives a consumer of mandatory protections or forum rights that cannot lawfully be waived. Where a transaction-specific or regional notice lawfully identifies an applicable Seller, governing law, or competent forum, that information applies to the extent permitted by mandatory law.
24. Electronic Communications
Purchase confirmations, account notices, billing or subscription notices, security notices, policy notices, and other transactional or service communications may be delivered electronically by email, account messaging, website notice, or another reasonable electronic channel, subject to applicable law. Consent to transactional or service communications does not by itself constitute consent to marketing communications where separate consent or opt-out rights apply.
25. Changes to the Service and These Terms
We may update the Service and these Terms prospectively as features, entities, vendors, business operations, or applicable law change. Where legally required, additional or advance notice of material changes will be provided. A change does not retroactively rewrite a completed transaction or remove rights already accrued under mandatory law.
26. Standard Contract Clauses
Assignment. The applicable Operator may assign or transfer rights and obligations in connection with an affiliate reorganization, financing, merger, acquisition, sale, transfer of the Service, or similar business transaction, subject to applicable law. You may not assign or transfer your rights or obligations except where permitted by law or with prior written consent.
Force Majeure. We are not responsible for delay or failure caused by events outside reasonable control, except to the extent mandatory law provides otherwise.
Severability. If a provision is invalid or unenforceable, it will be limited or severed to the extent legally required and the remaining provisions will continue in effect where permitted.
No Waiver. Failure to enforce a provision on one occasion does not waive the right to enforce it later.
Entire Agreement. These Terms, the incorporated policies, and applicable transaction-specific checkout terms and purchase records constitute the contractual framework governing the Service and the relevant transaction.
27. Language
The English version of these Terms is the original version. If a translated or localized version differs from the English version, the English version controls to the extent permitted by applicable law. Mandatory local-language requirements remain unaffected.
